Home health care is quickly taking the place of other care options such as nursing homes, and the demand for quality home care is high.

Most private duty providers fall into one of two categories: a private duty agency that employs their workers, or a registry that uses independent contractors, also known as a referral service or a nursing registry. In most cases, the client is the legal employer of the registry-assigned caregiver and assumes responsibility for withholding taxes and providing worker's compensation.

Although Medicare certifies home health agencies, only a handful of states currently require private duty providers to be licensed. When seeking home care, use this checklist to help you understand your rights and responsibilities:

• How long has the agency been providing private duty home care?

• Who employs the caregiver?

• How often are caregiver services monitored?

• How are caregivers screened and selected for an assignment?

• Are references checked and criminal background and drug screens conducted on all employees?

• Is an individualized plan of care developed by a healthcare professional, the client, and family members?

• How are emergencies handled after normal business hours?
